What Makes for Effective Mediations: How to Get What You Want Friday, April 14, 2017 Although there are no mysterious techniques, tricks or special practices which will assure a good outcome, certain conduct by counsel all but guarantees a failed mediation. Eric Sanders will offer a succinct, candid presentation about the things you can do, and not do, to achieve a fair outcome for a client through this important dispute resolution process. Alan Kirtley will discuss several keys to getting the most from a mediation. They include: understanding your client’s and the other side’s interests; preparing thoroughly; selecting the right mediator for the case; involving the client effectively during mediation; advocating to persuade an adversary (not a judge or jury); mastering the strategic use of concession points; recognizing (and overcoming) barriers to settlement; using the mediator to bridge differences; and, identifying viable alternatives to settlement.
